TERMS AND CONDITIONS

STATEMENT

Subject to conditions listed below, SOLTITE warrants its direct customer that the mounting structures provided will be free from structural failure for 12 (twelve) years from the date of delivery.

Should structural failure occur, SOLTITE will, at its option and expense and as its sole obligation, replace the defective component with a new or updated component. Performance under this Warranty Agreement will not trigger the commencement of a new warranty period, nor will it extend the applicable warranty period.

 

CONDITIONS

The foregoing warranty statement is subject to the following conditions:

  • The mounting structures are handled and installed by a qualified installer in accordance with the provided SOLTITE installation manuals.
  • The mounting structure components were transported, stored, installed, assembled or operated in accordance with prudent industry methods and best practices.
  • During its lifetime it is the responsibility of the customer to maintain the products in accordance to the SOLTITE inspection and maintenance plan. The customer is therefore required to conduct annual inspections of the mounting structure and to provide annual maintenance which includes, but is not limited to: ensuring specified torque values on nuts and bolts are maintained; subsequently tightening any loose nuts, bolts and screws or any other connections; inspecting the mounting structures for signs of excessive corrosion and, if found, notify SOLTITE of said corrosion occurences immediately.
  • SOLTITE will not be held responsible for the self-loosening of bolts, nuts and screws under any circumstances. This includes, but is not limited to, unforeseen conditions and events like force majeure, seismic activity, unprecedented temperature fluctuations, vibration caused by structurally unsound roof structures or construction ensuing on or nearby said roof structures, or faulty workmanship resulting in over-tightening, under-tightening or the damaging of said fasteners.
  • It remains imperative that deterioration is not caused by excessive exposure to standing water, corrosive chemicals, smoke or rainwater containing carbon, deposits of particles of heavy metals such as iron or copper, or alkaline products such as ash, cement dust or animal excrement.
  • The mounting structure is not subject to extraordinary environmental conditions (excess voltage, seismic activity, magnetic fields or similar circumstances).
  • The mounting structure is not subject to force majeure events (storm, hail, flooding, lightning, hurricane, tornado, earthquake, fire, instability of the subsurface or foundation, strikes, war, or events out of SOLTITE’s control).
  • The visual aspect of the cut edges and discolouration of the surface due to run-off from cut edges or adjacent parts is not covered by this warranty.
  • This warranty is not valid for areas with high airborne abrasion (e.g. desert zones prone to sand storms or strong sand-bearing winds).
  • The load capacity of the roof construction and/or the foundations, footers or ground have been assured according to the accepted state-of-the-art technology and applicable technical norms and regulations.
  • The amount of solar panel modules on the roof structure – including the total weight of the mounting structure – is approved and based on the mandatory structural stability study report acquired and considered by the customer.
  • Any modifications and/or alterations to the mounting structure, including adding third-party components to the structure not supplied by SOLTITE or replacing components supplied by SOLTITE with third-party components will declare this warrantly void.

 

CLAIMS

To invoke the warranty, SOLTITE must be notified in writing within five (5) days of the identification of any defect indicating a potential problem with the elements of the mounting structure and given SOLTITE a reasonable opportunity to inspect the mounting structures.

SOLTITE will, at its sole option and discretion, in order to find the most appropriate and cost-efficient way to solve the issue, either repair or deliver adequate replacement products free of charge.

In the case of hidden defect(s) to the mounting structure, SOLTITE will take in charge the direct costs related to the replacement or repair of the final product, provided such costs have been mitigated by the customer.

 

LIABILITY LIMITS

  • SOLTITE warrants no items or components furnished or warranted by others, or any item or component which is supplied by SOLTITE and altered, damaged or misused by others.
  • SOLTITE will not be liable for repairing direct or indirect damage caused by third parties.
  • The Warranty Agreement does not cover photovoltaic modules, electrical components, wiring connections, or any other accessories, fixtures, insulation, goods, or materials not directly associated with the mounting structure.
  • This Warranty Agreement does not apply if the defects or discrepancies in the condition of the mounting structure are not material and such defects or discrepancies are insignificant with respect to the value of the mounting structure.
  • SOLTITE is not liable for any delays or failure to honour the warranty, if that delay or failure is caused by force majeure.
  • The total scope of liability under this Warranty Agreement is limited to the purchase price paid by the customer for the mounting structure.
  • SOLTITE will not be liable for any consequential or incidental damages arising from or out of the installation or use of the supplied products. In such event, SOLTITE will not be liable for personal injury, property damage, lost revenue, operational disruptions or downtime.
  • SOLTITE accepts no liability for losses or damages arising from the determination of environmental parameters, wind loads, location of installation and the resulting selection of a solar powered system. The sole responsibility for this assessment remains with the customer.
